Great point Eli! Sorry it took a little time to respond to this – hence the foiled formatting in the post here.  We are going to send this around our attorney community and see what their thoughts are.  As an attorney, I would agree that “opting in” is always a sure fire way of getting people under your TOU. A great place to do this is when your user signs up for your service.

One thing my lawyer stressed to me was having the user EXPLICITLY opt in to the TOU.  Some apps auto-check a checkbox; some say at the bottom of the page “by using the app you automatically agree to the TOU/T&C.”  But after dealing with too many legal cases where users claimed they were “tricked” into agreeing to the terms, he recommends making the user take an explicit action to opt in — instead of opt out — of your terms.
